Internal information and defense system for informants (SIDI)

In application of article 13 of Law 2/2023, of February 20, regulating the protection of people who report regulatory infractions and the fight against corruption, which states that all entities that make up the public sector, including Public bodies and entities linked to or dependent on any Administration are obliged to have an internal information system in which these communications and complaints can be received. The SIDI of the Segura Hydrographic Confederation, O.A., is created, this being the internal channel. preferential for the communication or reporting of infractions within the scope of competence of the aforementioned body.

The Segura Hydrographic Confederation, O.A. accepts anonymous communications and complaints, so it is not mandatory to identify yourself to file a complaint or communicate information. In the case of providing us with your identity, the Confederation guarantees the total confidentiality and reservation of your data.

General scope:

This mailbox is only for reporting an action by the Segura Hydrographic Confederation, O.A. that may be considered a violation of European or national regulations:

  • Actions or omissions that are illegal and are related to, or distort the object or purpose of the rules established in, the acts and areas of action of European Union law established in article 2 of the LPPI.
  • Actions or omissions that may constitute a very serious or serious criminal or administrative infraction of national law.

Who can communicate in this mailbox?

This space is reserved for individuals who have or have had a professional relationship with the Segura Hydrographic Confederation, O.A. (employees, contractors, suppliers, recipients of subsidies, etc.).

If you wish to report an infraction by this Organization, but do not belong to the persons indicated above, you must go to the external information channel. Until the Independent Whistleblower Protection Authority A.A.I. is configured, you can go to the equivalent mailbox of the corresponding Administration or to INFOFRAUDE for the communication of information on fraud or irregularities affecting European funds.

What characteristics does communication have?

Guarantee:

  • The communications made may be nominative or anonymous at the discretion of the informant.
  • In any case, the confidentiality of the informant will be maintained.
  • The informant may receive communications and information related to his or her complaint.
  • The informant may monitor the status of his or her complaints and provide additional information to a previously made complaint.
  • If you decide to use this channel anonymously, you will only be able to receive information through the tracking code generated by the system.

Protection of the informant:

  • Acts of retaliation, including threats and attempted retaliation against persons who submit information about violations in accordance with the provisions of the LPPI, are expressly prohibited. When the requirements established in Law 2/2023 are met, the SIDI must guarantee the prohibition of retaliation, the measures against them and the support required within the scope of the CHS.
  • Administrative acts whose purpose is to prevent or hinder the presentation of public communications or disclosures, as well as retaliation after such presentation under the LPPI, will be null and void, and will give rise to disciplinary corrective measures or liability, and may include compensation for damages.
  • During the processing, the people affected by the communication will have the right to the presumption of innocence, the right of defense and the right of access to the file in the terms regulated in the LPPI, as well as the same protection established for informants. , preserving their identity and guaranteeing the confidentiality of the facts and data of the procedure.

Content of communications:

  • The communication must contain clear and concrete identifying elements that can be verifiable or verifiable directly or through research. To do this, you must provide a detailed description of the events, dates, places, people and entities involved and provide, if possible, documentation that allows proof or at least the evidence on which it is based. It is also advisable to indicate other people who could help corroborate the facts.
  • Generic, indeterminate complaints or complaints that lack sufficient elements for investigation WILL NOT BE ADMITTED.
